Terms of use and conditions of service
Last updated: October 2026. These terms govern the use of this site and describe the general conditions of Tax Planning Plus LLC services.
1. General information, not advice
The content of this site, including the Resources articles, is general information on tax topics as of its publication date. It is not advice for your case, may not reflect later changes in the law and should not be used to make decisions without an analysis of your facts.
2. Professional relationship and engagement letter
A signed engagement letter is required for any service. It defines the scope of work, the fees and each party's responsibilities. A professional relationship with Tax Planning Plus begins only when both parties sign it; no work starts before then. Contacting us through this site, by phone, WhatsApp or at an initial appointment does not create that relationship. If these terms and the engagement letter differ, the engagement letter controls. When the relationship begins, every client receives the welcome letter with these terms and conditions and signs it separately from the engagement letter to confirm they have read and accept them.
3. Who we are and what we do not do
We are a tax preparation and business services firm. Our professionals holding the Enrolled Agent credential are authorized by the Department of the Treasury to represent taxpayers before the IRS and are governed by Circular 230 (31 CFR Part 10). We are not a law firm and do not provide legal services, we are not certified public accountants and do not issue audit opinions, and we do not provide investment advice.
4. Client responsibilities
You are responsible for giving us complete, truthful and timely information, and for reviewing your return before signing it, because you sign it under penalty of perjury. We may rely in good faith on the information you provide, but we will make the reasonable inquiries professional rules require. For certain credits and head of household status, the law requires us to meet due diligence requirements and to ask you for supporting documents; if you do not provide them, we cannot claim those benefits.
5. Documents and communications through the secure portal
All case information and documents are received and delivered through the firm's secure client portal, our client management system (CRM). For security reasons, the client agrees not to send case information or documents through any other channel, such as email, WhatsApp, text messages or this site's form, and not to deliver physical documents except to persons of the firm previously authorized to receive them. To the extent permitted by law, the firm is not responsible for the loss, exposure or misuse of information the client sends or delivers outside these channels; that responsibility rests with the client. You are also responsible for protecting your portal login credentials.
6. Authorizations and signatures
To e-file your return, you must first sign the IRS e-file authorization: Form 8879 for individual returns and its equivalent for business returns. We do not file any return without that signed authorization. To represent you before the IRS or receive your tax information, you must sign, as applicable, Form 2848 (power of attorney) or Form 8821 (tax information authorization).
You agree to sign engagement letters, authorizations and forms electronically where the law and the receiving authority allow, under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN) and the Florida Uniform Electronic Transaction Act (Florida Statutes section 668.50), with the identity verification the IRS requires. Some documents do not accept electronic signatures and require an original ink signature, such as the ITIN application (Form W-7) and certain paper-filed forms or documents required by third parties such as banks or notaries. We will tell you in each case which type of signature applies.
7. Our team and consent to share your information
Your case is handled by the firm's tax team, which includes preparers and support staff in the United States and in other countries, always under the final review of an Enrolled Agent. Within the United States, the law allows us to share your information with the preparers working on your return.
For preparers located outside the United States to work on your case, Internal Revenue Code section 7216 requires your written consent, on the form and with the wording the IRS prescribes. Your Social Security number is shared outside the country only if you expressly authorize it and both the firm and the receiving preparer maintain the data protection safeguards the IRS requires; otherwise it is masked before the document is shared. For individual returns, signing this consent is voluntary and we do not condition our services on it: if you do not sign it, your case is handled only by staff in the United States.
8. Confidentiality
We handle your information under our privacy notice, Internal Revenue Code section 7216 and the Gramm-Leach-Bliley Act. Code section 7525 gives communications with a federally authorized tax practitioner a limited confidentiality protection, only in noncriminal tax matters before the IRS or federal courts; it does not protect return preparation information or criminal matters. If your situation may have criminal implications, you should consult an attorney.
9. Appointments and service
Office visits are by appointment only, confirmed in advance by phone or WhatsApp. Appointments booked online are remote video meetings (Zoom). We are open Monday to Friday, 9:00 a.m. to 6:00 p.m.
10. Fees and payments
Every case is evaluated before quoting, and fees are set in writing in the engagement letter. We do not charge contingent fees except where Circular 230 permits. Payments are made through the firm's payment link or with the instructions that accompany your invoice; we never change payment instructions by email. Before disputing a charge with your bank or card issuer, contact us to resolve it.
11. Recurring annual services
Some business services are annual and renew each year while active: registered agent service, the assigned physical or mailing address, when the client requests it, and handling of the company's annual report with the state, whose official fee varies by state and is set by each state. Current amounts are stated in the engagement letter. Registered agent service and the assigned address renew every twelve months from the service start date, which depends on when the company was formed or registered, and are invoiced 60 days before expiration. The annual report is billed when each state requires it, according to its due date. Tax return preparation is not included in these annual services: it is quoted separately and its cost varies with the complexity of each return. If the client does not wish to renew a service, the client must notify us in writing before the renewal date. If an annual service is not paid, the firm may stop providing it and, for registered agent service, resign from that role under state law; the lack of a registered agent or annual report can lead to penalties or administrative dissolution of the company.
12. Client records
On request, we will return your original records under Circular 230 section 10.28. We keep prepared returns and each case file for at least six years from filing, because in certain cases the IRS has up to six years to examine a return. We recommend that you also keep your own copies and supporting documents for that period.
13. Third-party links and services
This site links to the client portal, payment, scheduling and video services, social media, other firms in our group such as SOLON and Padilla Advisory Group, which are independent entities with their own terms, and organizations such as Federal Tax Defense Foundation. We are not responsible for the content or practices of those sites.
14. Limitation of liability
The site is provided as is. To the extent permitted by law, Tax Planning Plus is not liable for damages arising from use of the general content of this site without a formal professional relationship. Liability for engaged services is governed by the engagement letter.
15. Intellectual property
Tax Planning Plus™ and its logo are trademarks of Tax Planning Plus LLC. The text and design of this site are its property and may not be reproduced without permission. Enrolled Agent is a designation granted by the Department of the Treasury; its use does not imply IRS endorsement.
16. Governing law
These terms are governed by the laws of the State of Florida and, where applicable, the federal laws of the United States. Any dispute will be submitted to the competent courts of Miami-Dade County, Florida, unless the engagement letter provides otherwise.
17. Accessibility and language
This site is available in English and Spanish. If you have difficulty accessing any content, write to us and we will provide it in another format. If the versions differ, they are interpreted in good faith according to their common intent.
18. Changes
We may update these terms; the current version is the one published on this site. Questions: info@taxplanningplus.com, 1-888-INCOTAX.
